1. Acceptance of Terms

By downloading, installing, or using Proscle (the "App"), you agree to be bound by these Terms of Use. If you do not agree, strictly do not use the App.

2. Description of Service

Proscle is a mobile application designed to assist coaches and staff in managing American football athletes, tracking performance, and organizing team data.

3. User Accounts

  • Registration: You may need to create an account to access certain features. You agree to provide accurate information.
  • Security: You are responsible for safeguarding your account credentials. You must notify us immediately of any unauthorized use.
  • Eligibility: You must be at least 16 years old (or the minimum age of digital consent in your country) to use this App.

4. User-Generated Content

  • Responsibility: You are solely responsible for the content you upload (e.g., athlete data, photos). You represent that you have the right to upload such content and that it does not violate any third-party rights.
  • License: By uploading content, you grant us a non-exclusive license to use, store, and display that content solely for the purpose of providing the Service to you.
  • Sensitive Data: If you upload health or performance data of athletes, you warrant that you have obtained necessary consents from the individuals (or their guardians) as required by GDPR.

4.1 Data Collection by Organizations

You acknowledge that the collection, processing, and usage of athlete data within the App is performed by the specific organization (e.g., football team or club) where the athlete is registered.

  • Organization Liability: The respective organization is the data controller responsible for complying with applicable data protection laws (including GDPR) regarding such data.
  • Proscle Disclaimer: Proscle acts as a data processor providing the technical infrastructure. Proscle is NOT liable for any misuse, unauthorized collection, or mishandling of data by the organization. Users should refer to the privacy policy of their respective organization for details on how their data is handled.

5. Acceptable Use

You agree NOT to:

  • Use the App for any illegal purpose.
  • Upload content that is offensive, defamatory, or violates privacy rights.
  • Attempt to reverse engineer or compromise the App's security.
  • Use the App to manage data of individuals without their permission.

6. Intellectual Property

The App, including its code, design, and original content, is the property of KulinariQ GmbH and is protected by copyright laws.

7. Termination

We reserve the right to suspend or terminate your account at our discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

8. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability or fitness for a particular purpose. We do not warrant that the App will be uninterrupted or error-free.

9. Limitation of Liability

To the maximum extent permitted by law, KulinariQ GmbH shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your access to or use of, or inability to access or use, the App.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to its conflict of law provisions.
